The Trump EPA starts the process to rescind the Endangerment Finding on CO2. Climate activists and Democrats better hope it never reaches this Supreme Court.
Non profit Appalachian Mountain Club is advocating to keep the 2009 endangerment ruling by the EPA. I always thought them to be kind of a rational nonprofit but this seems to be going off of their mission. People need to wake up and realize that net zero is a mistake that the real war is intelligence in every watt produced is intelligence==AI. The Appalachian Mountain Club's mission is to protect the mountains, forests, waters, and trails of the Northeast and Mid-Atlantic regions, while also fostering the enjoyment and understanding of the outdoors through recreation, education, and conservation efforts, such as trail maintenance, advocacy, research, and community building. The AMC seeks to inspire people to connect with nature and to work towards a future where the natural world is healthy, protected, and accessible to all.
Even with the EF in the rear view there will be no change to the AMC remit or outcomes. I am a rabid conservative yet i abhor real pollution. Not sure why you think the change in EF (fingers crossed) will restrict or hinder your goals… other than ‘Mental’s point!
People need to wake up and realize that net zero is a mistake that the real war is intelligence in every watt produced is intelligence==AI. CCP CHINA gets it and is WINNING!
The rocks in the cogs of this articles pre-drawn conclusion - which by the way seems to be well researched -and is very well written and compiled:
--- is the physical makeup of the Supreme Court - along with the US Senate.
Conservatism - which is at the center of this - is the desire to keep things "...as they were..." i.e.. to literally return to the days when the Nobles and Kings of France, i.e, the Bourbon era in France ruled -- and commerce, i.e., making money - was unfettered by rules.
Check it out --it's where the Conservative Ideologies all came from, which then were taken up in England, and still is the Holy Grail of the present British Conservative Party - where they still have Kings.
The problem for Conservatism / and for Conservatives in the US - is that Conservatism and Conservatives as such - have never been a part of US History.
Conservatives, including the Supreme Court 6 and the US Senate are in the midst of trying to bringing forth either a King or Dictator to the US:
--- so that unfettered commerce; i.e., making all the money wanted- in any manner wanted - human and environmental damage not being in the Conservative agenda:
--- is the order of the day.
Don't be surprised if things are physically changed though - simply because of the fact that legal definition "manure" can be "shoveled" both ways.
If the people whom all of this legal manure maneuvering is supposed to protect - decides that they have had enough - and take decision making into their own hands as to who decides what: --- will do so.
This is exactly what caused the founding of this Country -- and they haven't forgotten it.
Well said. “Sue and settle” and Juris Dunning-Krugers who don’t know sh*t about science are a serious problem. And Congress needs to take guidance from scientists at agencies but write clear statutes, and have the gonads to change the statutes in situations like this. THAT is what we thing the Loper Court was saying. Thanks for the comment!
I've thought for a few years now that the social cost of carbon was misstatement. More CO2 is a net benefit, even if it does cause some immeasurable warming - still not conclusive in my mind, after following and even occasionally studying the subject for almost 20 years. EPA should be sending out checks to large carbon emitters.
This is quite a treatise and I will have to read it at least one more time to better digest. It's always seemed to me that the fatal flaw with our regulatory structure was to delegate rulemaking and rule-enforcement to a federal agency, or its proxy. These are rules, enforced as federal law, that are dreamed up mostly by agency attorneys, who often have little expertise or even interest in the subject matter and are totally focused on what may be a legally defensible policy. No science in that. Many of the regs came about from "sue and settle" actions, which honestly, sucks. That's a lousy way to make a law.
In my opinion, the EPA (and all government agencies) should serve purely to facilitate the legal, interstate and foreign commerce of the people and advise & make recommendations to POTUS and the Congress regarding laws deemed necessary to regulate such commerce. Congress needs to own up to this and take that power back and keep it where it should always reside, in the hands of the people's representatives.
Very thorough and informative. Thank you.
Thanks, enjoyed writing it!
Outstanding reporting and analysis. Attaboy, ‘Mental.
Thanks, Robert.
We don’t care what the American Wind Energy Association and the Solar Energy Industries Associations say about you … you’re alright by us.
😉 😂
fingers crossed that Mr Zeldin is successful
Yup. Timing is everything here.

Interesting.
Maybe it's keep the EF, b/c that keeps a constraint on O&G in the West Virginia, PA, OH regions?

Interesting take. Our differs.
Thanks.

Best news ever! May the implications of Chevron deference continue to manifest.
May it be so!
